DACA: Deferred Action for Childhood Arrivals

What is DACA:

It is a new program from the Department of Homeland Security ("DHS"), administered by the U.S. Citizenship & Immigration Service ("USCIS") to help young people who came to the United States as children. The requirements are fairly straightforward; the applicant:

  • must be under 31 years old as of June 15, 2012
  • entered the USA before turning 16 years old,
  • lived in the USA continuously from June 15, 2007 to the present time,
  • be in school (or have graduated from high school or earned a GED, or be a veteran of the U.S. armed forces), and
  • not be convicted of a felony, or 3 misdemeanors, or pose a threat to public safety or national security.
